These Terms of Service ("Terms") govern your use of NudgeUP ("Service"), operated by DryDev Solutions ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
You must be at least 13 years old to use NudgeUP. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
NudgeUP offers a free tier and paid subscription plans:
Subscriptions are billed in advance on a monthly basis. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through the Manage Subscription option in the app or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except as required by applicable law.
We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

NudgeUP uses Google's Gemini API to generate AI coaching responses. These responses are for motivational and productivity purposes only and do not constitute professional medical, psychological, or therapeutic advice. Do not rely on AI responses for decisions requiring professional expertise. We are not responsible for the accuracy or completeness of AI-generated content.
You retain ownership of the content you create in NudgeUP (tasks, notes, vibe check entries). By using the Service, you grant us a limited license to store, process, and transmit your content solely to provide and improve the Service. We will not use your personal content for advertising or sell it to third parties.
The NudgeUP name, logo, design, and all Service content created by us are owned by DryDev Solutions and protected by intellectual property laws. You may not copy, reproduce, or distribute our intellectual property without written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRYDEV SOLUTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You may delete your account at any time by contacting hello@getnudgeup.app. We may suspend or terminate your access to the Service at our discretion if you violate these Terms or for any other reason with reasonable notice, except in cases of serious violations where immediate termination may be necessary.
Upon termination, your right to use the Service ceases immediately. Sections 6–11 survive termination.
These Terms are governed by the laws of the United States. Any dispute arising from these Terms or the Service will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
